In February, after a detailed inspection by the Ministry of Funds and Regional Policy and the National Judicial Administration, NCRD decided to terminate 38 contracts, covering a total of more than PLN 195 million. These decisions were based on identified formal errors in the submitted applications. Our client, as a beneficiary of the competition, faced potential financial consequences.
Our intervention focused on demonstrating that the identified deficiencies in the documentation were insignificant in the context of the overall project and should not affect the decision to withhold funding. We argued that NCRD’s actions, while formally justified, were disproportionate to the project’s relevance to development policy and the country’s economy.
Thanks to our efforts, NCRD revised its position, recognizing our arguments. This decision made it possible to settle the dispute at an early stage and avoid lengthy court proceedings. Our client not only avoided repayment of the grant, but also gained the opportunity to continue the project, which will enable the implementation of innovative technical solutions that benefit both the industry and the wider community.
The legal team that supported our client included attorney Damian Wojnowski, legal counsel Zuzanna Bokina-Kiełbasa and trainee attorney Martyna Dobkowska-Pragacz. Thanks to their commitment and expertise, it was possible to achieve this significant success.
