It is clear from the Explanatory Memorandum to the draft Act amending the CEIDG that it primarily concerns amendments to the provisions aimed at simplifying the process of setting up and running a business by entrepreneurs – natural persons – and expanding the information made available by the Central Register and Information on Economic Activity, hereinafter referred to as ‘CEIDG’.
The planned changes set out in the draft are a response to the needs expressed by entrepreneurs during the period in which the provisions concerning the CEIDG and the Business Information Point have been in force. From the perspective of both business owners and other users of the system, it is crucial that the regulations concerning the CEIDG are regularly assessed and adapted to current economic conditions. This means that the range of public services available in digital form must be continually expanded. Both entrepreneurs and other users highlight the importance of being able to complete formalities and obtain information related to business activities in one place – the so-called ‘one-stop shop’ model. In response to these expectations, the Ministry of Development and Technology has drawn up a set of measures aimed at streamlining the conduct of business in Poland.
The key provisions of the draft bill include:
- simplifying procedures and creating a section within the CEIDG for publishing data on civil partnerships where the partners are entrepreneurs registered in the CEIDG;
- a transition to an exclusively electronic system for submitting applications for entry into the CEIDG, which means the complete phasing out of paper applications;
- full digitisation and expansion of the scope of information on powers of attorney granted by entrepreneurs, together with their publication in the CEIDG register;
- integration of the CEIDG system with other ICT systems to automate processes and streamline data flow;
- enabling licensing authorities to maintain registers of regulated activities as part of the service offered by the Ministry of Development and Technology;
- clarifying the data provided by licensing authorities and chambers of crafts;
- improving the efficiency and optimising the operation of the CEIDG and the Business Information Point, including expanding the list of documents that can be attached to an application;
- ensuring entrepreneurs have easy access to CEIDG data and services via the mObywatel app;
- clarifying regulations in certain areas, such as:
- succession administration,
- the disclosure of registry data,
- the functioning of the office of the liquidator,
- publication of information on craft qualifications,
- rules for correcting entries,
- the possibility for minors to make entries in the CEIDG
Partnerships – publication in the CEIDG of information on partnerships in which a partner is an entrepreneur registered in the CEIDG
The proposed changes regarding civil partnerships in which the partners are entrepreneurs registered in the CEIDG envisage a significant simplification of the information-sharing process and the full digitisation of procedures. There are plans to introduce a single registration application, which will enable the completion of all required actions (company registration, amendment, suspension, resumption, and deregistration) whilst integrating with the systems of the Tax Office (US), the Central Statistical Office (GUS) and the Social Insurance Institution (ZUS)/Agricultural Social Insurance Fund (KRUS). Expanding the scope of information published in the CEIDG, including the history of entries and details of representatives, is intended to ensure transparency in the operation of companies.
Online business registration
The next step in the development of the CEIDG system is the full digitisation of the business registration process. The project envisages a gradual move away from paper forms, starting with applications to start a business (from 1 June 2026) and ending with the remaining forms by 1 June 2028. At the same time, support tools are being developed – such as a helpline, live chat and a virtual assistant – to provide assistance with the online application process.
The mObywatel app – providing access to data contained in the CEIDG and enabling entrepreneurs to access services via the app
The mObywatel app, as a mobile tool widely used by citizens, will gain new features dedicated to entrepreneurs. Plans are in place to enable the viewing and modification of data contained in the CEIDG and the use of services based on registry data via mobile devices. The aim of these measures is to simplify access to information and reduce administrative costs.
Entrepreneur’s representative – digitisation and expansion of the scope of information in the CEIDG
In the area of business representation, the project provides for the possibility of publishing information in CEIDG about authorised representatives, including organisational units without legal personality, such as general partnerships. The entire process of registering powers of attorney will take place exclusively electronically, which will increase the efficiency and transparency of actions undertaken by authorised representatives.
Integration of the CEIDG system
The draft also provides for the alignment of CEIDG registration data with data contained in other state systems, such as TERYT, CRP–KEP or data from local authorities. The changes include the standardisation of addresses, the updating of historical data and ensuring compliance with the requirements of the Civil Code. These measures aim to ensure the consistency of registration information and improve the quality of public data.
Digitisation of Regulated Activity Registers
The project provides for the expansion of the scope of data transferred to the CEIDG by licensing authorities and the full digitisation of regulated activity registers. Ultimately, it is planned for the Ministry of Development and Technology (MRiT) to maintain the registers in the form of electronic services integrated with the CEIDG. This process will be implemented in three stages, concluding in December 2029.
Expanding the scope of services provided under the CEIDG
To enhance the functionality of the CEIDG, proposals include the option to attach VAT–Z documents to applications, which will allow for a more comprehensive settlement of an entrepreneur’s tax affairs in a single place. Additionally, the draft provides for the possibility of restricting the publication of contact details (telephone, email) and address details in specific situations.
Clarification of specific provisions
The amendment to the Act also covers procedural matters, including the correction of entries in the CEIDG, the functioning of the succession management body, the publication of information on craft qualifications, and the rules for using an entrepreneur’s account in the CEIDG system. These changes are intended to increase the transparency and consistency of the register’s operation.
In summary, it should be noted that the planned amendment to the Act on the CEIDG and the Business Information Point represents a tangible step towards simplifying and speeding up the day-to-day formalities faced by entrepreneurs. The draft responds to long-standing demands from the business community – including regarding the simplification of business registration, a reduction in the number of documents, the digitisation of dealings with the administration, and increased transparency of registry data.
Particularly beneficial changes concern civil partnerships, powers of attorney, integration with other registers, and the ability to handle matters via the mObywatel app. The new solutions have the potential to significantly reduce companies’ administrative costs and increase the availability of information essential for commercial, tender and investment relations.
