How a solar farm land lease is handled

A long-term lease of land for a renewable energy project calls for specific safeguards. Three steps.

  1. Initial analysis

    We take in your materials and examine the condition of the land, access to it and the legal limitations attached to the plot.

  2. Review or drafting

    We review the draft you received or prepare a new one, securing the landowner's position on rent, restoration of the land and risk.

  3. Finalisation

    We make the final adjustments, support the talks with the tenant and prepare the agreement for signature.

Who this service is for

Before land is tied to an investment for many years, the owner needs to know which obligations the lease creates and which clauses are worth changing. HWW reviews the draft lease presented by the developer or prepares a contract matched to the commercial understanding already reached. The work can be taken from the perspective of the landowner or of the investor, depending on who instructs us and what result is needed.

What a long-term lease has to settle

A solar farm occupies the plot for a period counted in years, so the lease has to settle how long and how much of the land is taken, what the owner receives for it and on what terms the land comes back. We look at the maintenance duties, the restoration of the land after the project ends, the indexation of the rent and the transfer of the lease within the developer’s structure. The price depends on the number of plots and owners involved and on whether the work is a review or a new draft.
