What concessions do I need to trade electricity in Poland?
To trade electricity in Poland, you need an OEE concession (koncesja na obrot energia elektryczna) issued by the President of URE (Energy Regulatory Office). The concession is granted for 10-50 years and requires a registered entity in the EU/EEA, sufficient financial resources, no tax arrears, and clean criminal records for company representatives. We handle the entire application process.
How long does it take to set up a company and obtain a concession?
Company registration (sp. z o.o.) typically takes 3-4 weeks via KRS court registration or 1-2 days via the S24 online system. Obtaining a URE energy concession takes 2-6 months depending on the type of activity and completeness of documentation. The entire process from first consultation to operational launch typically ranges from 4 to 12 months.
Can a foreign company apply for a URE concession directly?
Yes, but the applicant must have a registered entity within the EU, EEA, Switzerland, or Turkey. Most foreign companies choose to establish a Polish subsidiary (sp. z o.o.) or a branch office (oddzial) first, then apply for the concession through that entity. We advise on the optimal legal structure based on your tax and liability preferences.
What are the typical costs of entering the Polish energy market?
Costs vary significantly depending on the activity type. Company formation (sp. z o.o.) requires minimum PLN 5,000 share capital. URE concession applications involve government fees, notarial costs, and financial guarantees, certain activities require minimum share capital of PLN 10-20 million. We provide detailed cost estimates during the initial consultation.
Do I need a physical office in Poland?
Yes. A Polish registered entity needs a registered address (siedziba). For concession applications, URE may require proof of an actual office presence. We can help arrange a registered office in Warsaw or other Polish cities and assist with commercial lease negotiations, prime Warsaw office space ranges from EUR 19-27/sqm/month.
What is FDI screening and does it apply to my investment?
Since July 2025, Poland has a permanent FDI screening regime. If you are a non-EEA/OECD entity acquiring a significant stake in a Polish company operating in the energy sector with revenue above EUR 10 million, you must notify the oversight authority. The screening applies to energy infrastructure, including generation, distribution, and trading. We handle the entire notification process.
