How it works

How trademark registration proceeds

Registration is a procedure of filing the sign with the UPRP, examination by the office and, where the proceedings end favourably, issue of a certificate of protection. Four stages.

  1. Registrability search

    We carry out an initial analysis of whether the sign conflicts with existing rights and whether it meets the formal requirements.

  2. Preparation of the application

    We draw up the application with the description of the sign, the classification and the details of the applicant.

  3. Proceedings before the UPRP

    We monitor the proceedings, respond to requests from the office and defend the sign in the event of oppositions.

  4. Certificate of protection

    Where the proceedings end favourably, the sign is registered and a certificate of protection is issued to the applicant.

Who should register a trademark

Registration is worth considering for any brand, logo or slogan that a business wants to keep for itself. This matters particularly for companies building recognition on the market or planning expansion, because a known trademark is a valuable asset and deserves legal protection.

Why the registrability search comes first

The registrability search consists in checking whether the proposed sign conflicts with signs already registered and whether it contains elements that form a formal obstacle. A careful preliminary search reduces the risk of oppositions and of the proceedings being drawn out, and sometimes shows that the sign cannot be registered, which saves the fees on a hopeless application.

Protection outside Poland

An application before the UPRP produces protection on the territory of Poland. Where the plans reach further, protection at European Union level or an international route is the subject of separate work, and we say so at the search stage. For a business that sells abroad, the sequence of filings and the choice of classes are settled before the first application, so that the later steps build on it rather than repeat it.
