Law firm for cable pooling and shared infrastructure
Adding a storage unit to an existing installation, or opening a grid connection to a second investor, calls for agreements that settle the use of the cable, the substation and the metering equipment, the sharing of costs and the liability of each participant. Below we set out what such a matter requires of counsel and who leads this area at HWW.
What this matter requires of counsel
-
Starts by classifying the sharing model
A storage unit operating through the installation of a final customer and a separate generating unit behind a shared connection are legally different arrangements. Classifying the model has to come before drafting the agreement, because the scope of the whole documentation follows from it.
-
Matches legal title against technical parameters
Ownership of the installations, title to the land and to the shared equipment, capacity, ownership boundaries and metering points all have to line up. Counsel who works from the connection documents and the single-line diagram drafts terms that match the plant as actually built.
-
Separates the grid operator relationship from the arrangements between participants
The agreement between participants governs the funding of construction and repairs, cost allocation, failures, curtailment of output and the split of any compensation. That internal allocation does not narrow the rights of the grid operator, so both levels belong in the documentation as separate layers.
-
Provides for a participant leaving the arrangement
A sale of the installation, a change of participant and the end of operation each lead to different settlements. The agreement should set out in advance how expenditure is settled, how closing meter readings are taken, how equipment is removed and what further access to the infrastructure looks like.
