What it includes

  • We check whether the planned trading requires a licence or benefits from a statutory exemption (Article 32(1)(4) of the Polish Energy Law (Prawo energetyczne)). We do this to establish the right path for the company.
  • We prepare an application for a promise of a licence (promesa) or a promise of its amendment (Article 43(1) to (5) of the Energy Law). We do so if the company chooses this stage of preparing its business.
  • We assess the conditions for obtaining a licence and prepare an application with documents confirming the company's situation (Article 33(1); Article 35(1) of the Energy Law).
  • We prepare supplements to the application and explanations for the President of URE (Article 35(2a), (2b) and (3) of the Energy Law). We also file an appeal against a refusal of the licence to the Regional Court in Warsaw, Court of Competition and Consumer Protection (Article 30(2) of the Energy Law).
  • For cross-border trading in natural gas we determine the planned average daily imports and analyse the diversification of supplies (Article 32(2); Article 35(1a) and (1aa) of the Energy Law). An application concerning exports only does not require the planned average daily imports to be specified (Article 35(1aa) of the Energy Law). We also assess mandatory stocks with a view to maintaining the licence (Article 41(2a) of the Energy Law).
  • We help prepare financial security, if the President of URE makes the granting of the licence conditional on it (Article 38(1) of the Energy Law).
  • We prepare an application to amend the licence and represent the company in ex officio proceedings to amend its conditions or revoke the licence (Article 41 of the Energy Law).
  • We calculate the annual licence fee and prepare the form and the information requested by the President of URE (Article 34(1), (2), (4) and (5) of the Energy Law). For this we use data on the company's revenue.

What the price does not include

  • Preparation of a tariff or a hedging strategy, or handling of REMIT and CEREMP.
  • Negotiations of commercial contracts and disputes with counterparties.
  • Defence in criminal proceedings and representation in separate financial penalty proceedings.
  • Official fees, the annual licence fee or the funds needed for financial security.

What you receive

  • An assessment of the scope of the licence and a list of documents the company is to provide.
  • An application for a licence, a promesa or an amendment of the licence together with annexes, according to the commissioned stage.
  • Letters to the President of URE and an appeal against a refusal, if the matter requires that step.
  • A calculation of the licence fee, the form and answers concerning its calculation.

We indicate which information requires a decision of the management board and which requires confirmation by the accounting department.

Who this service is for

We help companies launching trading, expanding their trading to include natural gas from abroad, or responding to a request concerning a licence. We determine what the company buys, to whom it sells and from where it imports gas. We match the scope of the application and the financial documents to this model.

Please prepare

  • A description of purchases and sales, products, customers and countries of supply.
  • The company’s registration data, a description of technical facilities and staff qualifications.
  • Financial statements and documents concerning available funds and planned financing.
  • Licences held, promesas, applications, requests and decisions together with dates of delivery.
  • For planned imports of natural gas: directions of supply, the volume of imports and documents concerning stocks.

When this service is not enough

The tasks listed in the section “What the price does not include” require a separate agreement on scope and fee.

What the fee depends on

In the quotation we indicate the commissioned tasks, including the scope of work concerning the promesa and the appeal, and the years covered by the licence fee service.

  • The number of companies and types of business covered by the engagement.
  • Domestic trading or cross-border trading in natural gas.
  • The completeness of documents and the way the business is financed.
  • The stage of the matter: a new application, an amendment of the licence or proceedings after a refusal.

The final quotation depends on the client’s factual and legal situation; we present it once we know that situation, before work begins.

To discuss the matter with a lawyer first, you can book a consultation for PLN 600 net + VAT. If you then order the work, its cost is credited against the fee for this project.

The price is indicative and does not constitute an offer within the meaning of the Polish Civil Code.
