What it includes

  • We examine the exemption for sources with up to 5 MW of total installed thermal capacity (Article 32(1)(1)(e) of the Polish Energy Law (Prawo energetyczne)). We assess the network and trading where the contracted capacity is up to 5 MW (Article 32(1)(3) and (4)(a) of the Energy Law). We examine the disputed exemption in Article 32(4) of the Energy Law. We examine the supply of all heat from a source to a customer or group of customers for industrial processes and necessary accompanying needs (Article 32(4a) of the Energy Law). We verify the absence of supply to residential premises in the transmission and distribution of that heat (Article 32(4b) of the Energy Law).
  • We prepare the application, the description of the activity and the financial documentation (Article 35(1) of the Energy Law). For transmission or distribution, we include the draft development plan (Article 16(1) of the Energy Law). We verify the financing, the technical resources, the staff qualifications and the licence obstacles (Article 33(1) and (3) of the Energy Law).
  • We draft the supplements and explanations (Article 35(2a), (2b) and (3) of the Energy Law). We monitor the deadline for a heat pump (Article 32(1b)(3) of the Energy Law).
  • We examine the tariff exemptions (Article 47(1c) and (1d) of the Energy Law). If the tariff requires approval, we file the first application without delay, no later than 30 days from obtaining the licence (Article 47(1b) of the Energy Law). We verify the admissibility of advance payments and the settlement of overpayments (Article 47(1b) of the Energy Law).
  • We apply for an amendment of the licence also where there is a new source or a network extension (Article 35(2a) and (2b) of the Energy Law). We represent the client in ex officio proceedings on an amendment of the conditions or the revocation of the licence (Article 41(1), (1a), (2) and (3) of the Energy Law).
  • We appeal to the Regional Court in Warsaw, Court of Competition and Consumer Protection, against a refusal, amendment or revocation of the licence (Article 30(2) of the Energy Law). The time limit is 14 days from the delivery of the decision (Article 30(2) of the Energy Law).

We coordinate submitting the report to the President of URE and publishing information on the undertaking's website by 31 March each year (Article 7b(5) of the Energy Law). The data include, among other things, the shares of renewable energy, waste heat and cogeneration. We collect data from generators and undertakings supplying heat from another network by 31 January (Article 7b(6) and (7) of the Energy Law).

Questions and answers

Does industrial heat always exclude the licence obligation?

Not automatically: the interpretation of Article 32(4) of the Energy Law is disputed. Article 32(4) reads: “Obtaining the licence referred to in paragraph 1 point 1 is not required for conducting business activity in the generation of heat obtained in industrial technological processes”. The provision adds: “as well as where the amount of capacity contracted by customers does not exceed 5 MW”. The law firm assesses the separateness of the conditions and the industrial character of the process in an installation, for example a server room.

What financial documents should be prepared?

An entity conducting business activity presents financial statements for the last 3 years (Article 35(1)(3) of the Energy Law). We verify whether the financial documents and the technical description correspond to the scope of activity indicated in the application.

What is the time limit for supplementing the application?

The time limit is at least 21 days from the delivery of the request (Article 35(2a) of the Energy Law). An application not correctly supplemented within the time limit is left without examination (Article 35(2b) of the Energy Law). The company should keep the confirmation of delivery.

Do heat pumps have a special time limit?

Yes, at most 30 days from the President of URE receiving the complete application (Article 32(1b)(3) of the Energy Law). The provision concerns the grant or amendment of a licence for generating heat with a pump with an installed electrical capacity of up to 50 MW. The company verifies the electrical capacity in the documentation.
