PERSONAL DATA PROTECTION

1 Scope of the privacy policy

In accordance with Art. 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016. on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as "RODO"), the following are the rules for the processing of personal data by the Law Firm HWW Hewelt Wojnowski i Wspólnicy Sp.k. headquartered in Warsaw (hereinafter referred to as the "Law Firm") applicable to persons contacting the Law Firm on behalf of the following categories of entities:

  1. Clients using legal services provided by the Firm (including employees and associates of the Firm's clients);
  2. Entities interested in using the legal services provided by the Firm (potential Clients of the Firm);
  3. contractors (business partners) with whom the Firm cooperates in the course of its business activities;
  4. entities providing services that the Firm uses in connection with its business activities (including accounting, IT services);
  5. entities sending an inquiry via the contact form on the Law Firm's website available at https://hww.pl/ (hereinafter the "Website");
  6. entities aimed at obtaining from the Law Firm or providing to the Law Firm (by phone, email, in person) any information related to the Law Firm's business activities.

The administrator of personal data of persons contacting the Law Firm on behalf of the entities indicated in point 1 above is the Law Firm, operating in the form of a company under the name of "HWW Hewelt Wojnowski Lindner i Wspólnicy Spółka komandytowa" with its registered office in Warsaw (postal code 00-845) at ul. Łucka 18 lok. 4/L, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, XIII Economic Division. 4 Categories of personal data

The Firm processes the following personal data of persons contacting the Firm on behalf of the entities indicated in point 1 above:

  1. In the case of the entities indicated above in point 1 lit. a) b) c) (d) that are not natural persons - Identifying information, including the name, surname, business or private telephone number and email address of the person contacting the Law Firm, the name and address of the entity on behalf of which the person contacts the Law Firm, the position held or information about what type of matters the person handles;
  2. In the case of the entities indicated above in point 1 lit. a) b) c) (d) being natural persons not engaged in business activities - identification data, including name, surname, private telephone number and email address, residential address, PESEL number, ID card number;
  3. In the case of the entities indicated above in point 1 lit. a) b) c) (d) who are natural persons engaged in business activities - Identifying information, including name, surname, business or private telephone number and email address, name and address of the entity on behalf of which the person contacts the Firm, Tax ID number, REGON number, position held or information on what type of matters the person handles;
  4. In the case of the entities indicated above in point 1(e) sending an inquiry through the contact form on the Law Firm's Website - identification data, including first name, last name, business or private email address;
  5. In the case of the entities indicated above in point 1(f) aimed at obtaining from the Law Firm or providing the Law Firm with any information related to the Law Firm's business activities - identification data, including the name, surname, business or private telephone number or email address of the person contacting the Law Firm, the name and address of the entity on behalf of which the person contacts the Law Firm, the position held or information about what type of matters the person handles.

5. purposes and legal basis for data processing

Personal data of persons contacting the Firm on behalf of the entities indicated in point 1 above will be processed by the Firm for the following purposes:

  1. performance of agreements concluded with the Firm's clients, contractors (business partners) of the Firm or entities performing services for the Firm (Article 6(1)(b) RODO);
  2. to present an offer to a potential client of the Firm and take other actions at the client's request before concluding a contract (Article 6(1)(b) of the DPA);
  3. Performance of a contract for the provision of services by electronic means consisting in enabling the sending of an inquiry via the contact form on the Law Firm's Website (Article 6(1)(b) of the DPA);
  4. Fulfillment of legal obligations incumbent on the Law Firm resulting from agreements concluded with the Law Firm's Clients, contractors (business partners) of the Law Firm or entities providing services to the Law Firm (Article 6(1)(c) RODO);
  5. to obtain or provide information related to the law firm's business activities, to establish, investigate or defend against possible claims, for archival (evidential) purposes to secure information in case of a legal need to prove facts, for direct marketing of the law firm's products and services
    (in the case of obtaining consent to send requested commercial information) - which purposes constitute the law firm's legitimate interest (Article 6(1)(f) RODO).

6 Source of personal data

The personal data of the persons contacting the Law Firm on behalf of the entities indicated in point 1 above were obtained by the Law Firm either directly from the above. persons contacting the Law Firm or from the entities indicated in item 1 above, on behalf of which the aforementioned persons contact the Law Firm. persons contact the Law Firm.

7 Voluntariness of providing personal data

Providing the above data is voluntary, however it is necessary for the Law Firm to execute agreements concluded with the Law Firm's Clients, contractors (business partners) of the Law Firm or entities performing services for the Law Firm, to enable sending an inquiry through the contact form on the Law Firm's Website, to present an offer to a potential Client of the Law Firm, to obtain or provide information related to the Law Firm's business activity. Failure to provide the data indicated in point 4 above will result in the Law Firm's inability to perform the activities indicated above.

8 Security of personal data

The Law Firm shall exercise due diligence to ensure adequate protection of personal data, in particular, it shall apply the organizational and legal measures required by Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016. on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation).

9 Recipients of personal data

Personal data of persons contacting the Firm on behalf of the entities indicated in point 1 above may be transferred to providers of services used by the Firm in connection with its business activities, in particular:

  1. entities operating ICT systems or providing ICT tools that provide IT services to the Firm;
  2. to accounting and bookkeeping offices providing accounting services to the Firm;
  3. to the Law Firm's associates who may participate in the provision of legal services to the Law Firm's clients and contact the entities indicated in point 1 above with all guarantees to ensure the security of the personal data provided.

10 Period of processing of personal data

Personal data will be processed by the Firm for the following period:

  1. in the case of data processed for the purpose of executing agreements concluded with the Law Firm's Clients, contractors (business partners) of the Law Firm or entities performing services for the Law Firm - until the execution of the agreements concluded, completion of cooperation and settlement of the aforementioned. cooperation conducted with a given Client, contractor (business partner) or entity performing services for the Law Firm - until the execution of the concluded agreements, termination of cooperation and settlement of the aforementioned cooperation;
  2. in the case of data processed for the purpose of presenting an offer to a potential Client of the Law Firm and taking other actions at the Client's request - until the offer is presented and other actions are performed for the potential Client of the Law Firm;
  3. in the case of data processed for the purpose of executing a contract for the provision of services by electronic means - until the time of handling and responding to the given inquiry sent via the contact form on the Law Firm's Website;
  4. in the case of data processed for the purpose of fulfilling legal obligations incumbent on the Law Firm resulting from agreements concluded with Clients, contractors (business partners) or entities providing services to the Law Firm - until the expiration of the period of storage of the aforementioned data. data required by the applicable law in this regard;
  5. in the case of data processed for the purpose of establishing, investigating or defending against possible claims - until the statute of limitations for claims;
  6. in the case of data processed on the basis of a legitimate interest pursued by the Law Firm - until you object to such processing.

11. rights related to the processing of personal data

Persons contacting the Law Firm on behalf of the entities indicated in point 1 above are entitled to the following rights related to the processing of their personal data by the Law Firm:

  1. The right to access the content of your data,
  2. rectify the data when it is incorrect,
  3. request deletion of data,
  4. Request for restriction of data processing,
  5. The right to data portability,
  6. object to the processing of data,
  7. lodge a complaint to the President of the Office for Personal Data Protection against the Law Firm's processing of personal data in violation of applicable law.

12. no automated data processing

Personal data of persons contacting the Firm on behalf of the entities indicated in point 1 above will not be processed by automated means, including profiling.

13. no transfer of data outside the European Economic Area

Personal data of persons contacting the Firm on behalf of the entities indicated in point 1 above will not be transferred outside the European Economic Area.

COOKIE POLICY

(1) For the purposes of monitoring traffic on the Law Firm's Website available at https://hww.pl/, facilitating the use of the Website and ensuring the highest possible quality of services provided electronically, the Law Firm uses information recorded by the server on the final device of the person using the Website, which is then read each time the Website is used (so-called "cookies").

2 The law firm uses the following types of cookies:

  1. Session cookies, which work only during one-time use of the Website allowing it to function properly;
  2. Persistent cookies, which remain on the end device after use of the Website;
  3. cookies of third-party entities that provide the Firm with services related to the functioning of the Website.

(3) A person using the Website may at any time change the settings of his/her terminal device so that it does not accept such files or informs about their transmission. It is possible to use the Website without using the cookie mechanism, but this may mean that some functionalities of the Website will not work properly.
